Tolu Health Terms & Conditions

1. Acceptance of Terms

By accessing or using the Tolu Health Platform (“the Platform”), operated by Hormonly Health Technologies (“Tolu,” “we,” “our,” or “us”), you agree to these Terms & Conditions (“Terms”).
If you do not agree, do not access or use the Platform.
You represent that you are at least 18 years old and have legal authority to enter into these Terms.
If using Tolu on behalf of an organization, you represent that you have authority to bind that entity.

2. Description of Services

Tolu Health is an AI-powered health assistant that helps users understand health patterns, track wellness data, and access educational resources.
Tolu provides informational and educational guidance only. It does not provide medical advice, diagnosis, or treatment, and no material on the Platform should replace consultation with a qualified healthcare provider.
Always seek professional medical advice for any medical condition or emergency.

3. User Accounts

To use certain features, you may need an account. You agree to:

  • Provide accurate, current, and complete information;
  • Maintain the confidentiality of your login credentials; and
  • Accept responsibility for all activity under your account.
    Tolu reserves the right to suspend or terminate accounts for misuse or violation of these Terms.

4. User Conduct

You agree not to:

  • Impersonate others or misrepresent affiliation;
  • Access systems or data without authorization;
  • Upload or distribute viruses, malware, or harmful code;
  • Interfere with or overload the Platform or its networks;
  • Use automated means (robots, crawlers, scrapers) to collect data; or
  • Engage in any activity that violates laws or compromises security.

5. Privacy

Your use of Tolu is governed by our Privacy Policy, which explains how we collect, use, and safeguard personal and health information.
By using the Platform, you consent to those practices.
Tolu is currently conducting a HIPAA Critical Controls Risk Assessment to ensure compliance with healthcare privacy and security standards.

6. Data Security and HIPAA Readiness

Tolu uses Amazon Web Services (AWS) as its secure, HIPAA-eligible hosting provider under an active Business Associate Agreement (BAA).
We employ administrative, technical, and physical safeguards such as encryption, access control, and security monitoring.
Tolu is presently in a HIPAA readiness phase, meaning the organization is implementing and validating required safeguards but has not yet completed formal HIPAA certification or audit.
Use of the Platform signifies your understanding that some features are still under assessment and improvement as part of ongoing compliance efforts.

7. Intellectual Property

All content, design elements, code, trademarks, and materials on the Platform are owned by or licensed to Tolu Health and are protected under intellectual-property laws.
You may not reproduce, distribute, or create derivative works without our written consent.

8. Disclaimers

The Platform, its AI-generated content, and all related materials are provided “as is” and “as available.”
Tolu makes no warranties—express or implied—regarding accuracy, reliability, or fitness for any purpose.
We do not guarantee uninterrupted or error-free service, nor that data transmissions will be completely secure or virus-free.
Any health-related insights generated by Tolu are for informational and educational purposes only.

9. Limitation of Liability

To the fullest extent permitted by law, Tolu Health and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of data, profits, or goodwill) arising from or related to your use of the Platform—even if advised of such damages.
Our total aggregate liability shall not exceed USD $100,000 or the amount you paid for use of the Platform in the twelve months preceding the claim, whichever is less.

10. Indemnification

You agree to indemnify and hold harmless Tolu Health, its affiliates, officers, employees, agents, and licensors from and against any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising from your:

  • Use or misuse of the Platform,
  • Violation of these Terms, or
  • Infringement of any third-party rights.

11. Termination

We may suspend or terminate your access without notice if you violate these Terms or if required by law or security concerns.
Upon termination, your right to use the Platform ceases immediately.
We may retain or delete your account information consistent with our Privacy Policy and data-retention obligations.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles.
Any dispute shall be brought exclusively before the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction.

13. Changes to These Terms

We may revise these Terms from time to time. Updates will be posted on the Platform with a new effective date.
Continued use of Tolu after changes are published constitutes acceptance of the revised Terms.

HIPAA Readiness Notice

Tolu Health operates under HIPAA readiness standards and is completing its HIPAA Critical Controls Risk Assessment with independent security consultants.
Our infrastructure is hosted securely on Amazon Web Services (AWS) under a Business Associate Agreement (BAA) and follows industry best practices for protecting health information. Formal certification and continuous monitoring will follow the completion of this phase.
